Welcome to the Pesticide Compliance Certification Board ("PCCB," "we," "us," or "our"). These Terms of Use govern your access to and use of our website, services, and certification programs.

By accessing or using our services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you may not use our services.

1. Acceptance of Terms

By submitting a certification application, creating an account, or using our website, you acknowledge that you have read, understood, and agree to these Terms of Use. These terms constitute a legally binding agreement between you and PCCB.

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.

2. Our Services

PCCB provides:

• Pesticide product compliance certification
• EPA registration and establishment number verification
• 25(b) exemption eligibility assessment
• Label review and FIFRA compliance evaluation
• Amazon Fast-Track certification services
• Canadian pesticide compliance certification
• Annual certification renewals

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Have the legal authority to enter into binding contracts
• Provide accurate and complete information
• Comply with all applicable laws and regulations
• Own or have authorization to certify the products submitted

4. Certification Application Process

4.1 Application Requirements

When applying for certification, you agree to:

• Provide accurate product information and documentation
• Submit physical product samples with complete labeling
• Disclose all active and inert ingredients
• Provide valid EPA registration/establishment numbers or claim 25(b) exemption status
• Pay applicable fees

4.2 Processing Timeline

Processing times are estimates and may vary based on application volume, product complexity, and completeness of submitted materials. Timelines begin when complete applications and samples are received.

4.3 Right to Refuse Service

We reserve the right to refuse certification services for any product that does not meet EPA compliance requirements, contains false information, or violates applicable laws and regulations.

5. Fees and Payment

5.1 Certification Fees

All fees are non-refundable once certification review has begun. Fees are clearly stated on our website and during the application process.

5.2 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees.

5.3 Annual Renewals

Certification is valid for one year from the date of issuance. Annual renewal fees apply to maintain compliance status in Amazon's system and other platforms.

6.1 Scope of Certification

PCCB certification verifies that product labels and documentation meet FIFRA compliance requirements based on information provided at the time of application. Certification does not:

• Guarantee EPA approval or registration
• Verify product efficacy or safety claims
• Test actual product formulation or ingredients
• Replace required EPA registration for non-exempt products
• Guarantee acceptance by Amazon or other platforms

6.2 Your Responsibilities

You remain responsible for:

• Maintaining valid EPA registration (if required)
• Ensuring product formulation matches labeling
• Compliance with all federal, state, and local regulations
• Updating certification if product or label changes
• Proper product use and distribution

7. Intellectual Property

7.1 PCCB Content

All content on our website, including text, graphics, logos, and software, is owned by PCCB or our licensors and protected by copyright and trademark laws.

7.2 Your Content

You retain ownership of product information and materials you submit. By submitting materials, you grant PCCB a license to use, reproduce, and store such materials solely for certification purposes.

8. Confidentiality

We treat proprietary formulation information as confidential. However, certain information may be disclosed to regulatory agencies or as required by law. See our Privacy Policy for details on how we handle your information.

10. Indemnification

You agree to indemnify and hold harmless PCCB, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, violation of these terms, or violation of any laws or third-party rights.

11. Prohibited Conduct

You agree not to:

• Provide false or misleading information
• Submit products containing illegal substances
• Misuse or alter PCCB certification documents
• Attempt to circumvent our certification process
• Use our services for unlawful purposes
• Interfere with or disrupt our website or services
• Reverse engineer or copy our systems or content

12. Termination

We may suspend or terminate your access to our services at any time for violation of these terms or for any other reason at our discretion. Upon termination:

• Your right to use our services immediately ceases
• Outstanding fees remain due and payable
• Issued certifications may be revoked
• We may delete your account and data

13.1 Informal Resolution

Before pursuing formal legal action, you agree to contact us at info@pesticideccb.org to attempt to resolve any disputes informally.

13.2 Governing Law

These Terms of Use are governed by the laws of the District of Columbia and applicable federal laws, without regard to conflict of law principles.

13.3 Jurisdiction

Any legal action or proceeding arising from these terms shall be brought exclusively in the courts located in Washington, DC.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and PCCB regarding the use of our services and supersede all prior agreements.
